Statement by Quebecor and Videotron on the Federal Court’s decision to dismiss Telus’ legal challenge concerning the purchase of 5G spectrum in Western Canada
MONTREAL, 22 October 2021 / CNW Telbec / – Quebecor and Videotron welcome the Federal Court’s refusal to grant Telus’ motion for an interlocutory injunction to suspend the granting of 3500 MHz spectrum licenses in Western Canada.
- considered that “Telus’ arguments are untenable and do not raise a serious problem” (paragraph 2);
- rejected “Telus’ assertion that Videotron needed a physical infrastructure in Western Canada be eligible “(paragraph 2);
- recognized that “the decisive factor is the public interest in fostering greater competition in the market for mobile telephony services” (paragraph 4);
- concluded that “the weakness of Telus’ record more than outweighs any greater harm to which Telus may be exposed” (paragraph 97).
Quebecor and Videotron are disappointed with Telus’ relentless efforts to block at all costs the implementation of government policy aimed at promoting the entry of a fourth player into the from Canada wireless market to create healthy competition where it does not exist and reduce the prices Canadians pay for mobile services.
The matter now passes to the merits. The arguments of Bell and Telus, members of the oligopoly, will be heard at a future hearing in court.
The legal maneuvers of Bell and Telus demonstrate, once again, that they cannot bow to the competition and that the interests of Canadians are eclipsed by their financial goals.
